{"id":1298,"date":"2016-07-11T01:47:44","date_gmt":"2016-07-11T05:47:44","guid":{"rendered":"http:\/\/lawflog.com\/?p=1298"},"modified":"2016-07-11T01:47:44","modified_gmt":"2016-07-11T05:47:44","slug":"sexual-misconduct-in-the-federal-judiciary-where-are-the-democrats-and-feminists-when-i-need-them","status":"publish","type":"post","link":"https:\/\/lawflog.com\/?p=1298","title":{"rendered":"Sexual misconduct in the federal judiciary: where are the Democrats and feminists when I need them?"},"content":{"rendered":"<p><a href=\"http:\/\/lawflog.com\/?attachment_id=997#main\" rel=\"attachment wp-att-997\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-997\" src=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/10\/Judge-Smith.jpg\" alt=\"Judge-Smith\" width=\"217\" height=\"241\" \/><\/a>Hillary Clinton is not the only person protected by a double standard. On Friday, the nation&#8217;s top judicial misconduct panel confirmed my suspicion that U.S. District Judge Walter S. Smith, Jr.&#8217;s colleagues tried to\u00a0<a href=\"http:\/\/www.wacotrib.com\/news\/courts_and_trials\/judicial-conduct-committee-orders-deeper-investigation-of-waco-federal-judge\/article_6a9a9023-c079-5556-ad37-ccf7d197320f.html\">downplay the extent of his sexual misconduct<\/a>.<\/p>\n<p>Last December, Smith was <a href=\"http:\/\/www.wacotrib.com\/news\/courts_and_trials\/waco-federal-judge-reprimanded-for-sexual-misconduct-stripped-of-new\/article_319e2f91-f1d7-5dfe-8311-550de00981a4.html\">reprimanded and partially suspended<\/a> for a year after I submitted evidence that he forcibly grabbed, groped, and kissed a female deputy clerk in his chambers, apparently <a href=\"http:\/\/DirtyRottenJudges.com\">while he was drunk<\/a>. \u00a0I <a href=\"http:\/\/www.wacotrib.com\/news\/courts_and_trials\/attorney-appeals-waco-federal-judge-s-reprimand-seeks-impeachment\/article_1f763ec3-a289-516b-b1e6-3fe577ea16c1.html\">appealed the decision<\/a>, arguing that Smith&#8217;s punishment was far too lenient. \u00a0I also noted that I had given\u00a0investigators the names of witnesses and victims from other alleged incidents, but\u00a0the investigators for the Fifth Circuit Judicial Council never contacted those witnesses or victims. (In fact, I have reason to believe that the Fifth Circuit judges <em>told<\/em> the investigators not to look into the other alleged incidents.)<\/p>\n<p>As I told the <a href=\"http:\/\/www.wacotrib.com\/news\/courts_and_trials\/judicial-conduct-committee-orders-deeper-investigation-of-waco-federal-judge\/article_6a9a9023-c079-5556-ad37-ccf7d197320f.html\"><em>Waco Tribune-Herald<\/em><\/a> on Friday, the Fifth Circuit judges couldn&#8217;t very well ignore the first incident, because I gave them a transcript of the victim&#8217;s testimony, but they sure ignored the other alleged incidents. Fortunately, the Committee on Judicial Conduct and Disability of the Judicial Conference of the United States (wow, that&#8217;s a mouthful) <a href=\"http:\/\/lawflog.com\/?attachment_id=1304\" rel=\"attachment wp-att-1304\">ordered the Fifth Circuit<\/a> to conduct a more thorough investigation. \u00a0The committee also ordered the Fifth Circuit to elaborate on its finding that Judge Smith had been deceptive during the investigation.<!--more--><\/p>\n<p>Smith&#8217;s case is looking more and more like that\u00a0of former <a href=\"https:\/\/en.wikipedia.org\/wiki\/Samuel_B._Kent\">U.S. District Judge Samuel Kent<\/a> of Galveston, a tyrannical alcoholic who, like Smith, served in an outlying courthouse where he was the only federal judge in town. \u00a0Kent received a four-month suspension for generic sexual harassment, and that probably would have been the end of the story but for the persistence of his victims, who told the <em>Houston Chronicle<\/em> that the &#8220;sexual harassment&#8221; included Kent tearing the clothes off of one of his victims, putting his mouth on her breast, and attempting to rape her. \u00a0The public outcry finally forced the Fifth Circuit to do the right thing and recommend impeachment.<\/p>\n<p>Yeah, the Fifth Circuit has a very poor record on matters of judicial integrity. \u00a0That&#8217;s why I sent a <a href=\"http:\/\/lawflog.com\/?attachment_id=1306\" rel=\"attachment wp-att-1306\">letter to Fifth Circuit Chief Judge Carl E. Stewart<\/a> this morning asking him to refer another pending\u00a0complaint against Judge Smith (about his <a href=\"http:\/\/www.wacotrib.com\/news\/courts_and_trials\/state-bar-files-allegations-against-waco-attorney\/article_5952415c-3174-54df-82c5-680476bc1e9f.html\">secret attorney-client relationship<\/a> with Greg White) to a different judicial circuit. \u00a0Then again, the Fifth Circuit may not be the worst. \u00a0I&#8217;ve previously reported how the judges of the D.C. Circuit, including President Obama&#8217;s Supreme Court nominee, Chief Judge Merrick Garland, have <a href=\"http:\/\/lawflog.com\/?p=1133\">circled the wagons<\/a> to cover up U.S. District Judge Ellen S. Huvelle&#8217;s role in a <a href=\"http:\/\/DirtyRottenJudges.com\">$7 million fraud<\/a>. The D.C. Circuit refused to investigate Huvelle, and now her colleagues on the district court are <a href=\"http:\/\/lawflog.com\/?p=1048\">trying to disbar me<\/a>. \u00a0It&#8217;s a drama worthy of the Clintons (and, as it happens, Hillary&#8217;s personal lawyer <a href=\"http:\/\/lawflog.com\/?p=1048\">signed the charges to disbar me<\/a>).<\/p>\n<p>COVERING UP THE COVER UP<\/p>\n<p><a href=\"http:\/\/lawflog.com\/?attachment_id=998#main\" rel=\"attachment wp-att-998\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-998 alignleft\" src=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/10\/Judge-Hudspeth.jpg\" alt=\"Judge Hudspeth\" width=\"206\" height=\"226\" \/><\/a>In this morning&#8217;s <a href=\"http:\/\/lawflog.com\/?attachment_id=1306\" rel=\"attachment wp-att-1306\">letter to Chief Judge Stewart<\/a>, I requested\u00a0the release of the Fifth Circuit\u00a0investigative report on Judge Harry Lee Hudspeth. According to Judge Smith&#8217;s victim, she reported the assault through the chain of command, but Judge Hudspeth (who was serving as chief judge at the time) covered up Judge Smith&#8217;s misconduct. \u00a0The investigation of Hudspeth was finished last year, but he\u00a0was <a href=\"http:\/\/lawflog.com\/?p=1152\">allowed to retire quietly<\/a> in January, most likely to avoid the embarrassment of judicial discipline. \u00a0Since then, the investigative report has been held in limbo. One cover-up begets another, it seems.<\/p>\n<p>Shelley Saltzman, an assistant to Chief Judge Stewart, wrote in a May 2, 2016 email that judicial misconduct cases are normally dismissed when a judge resigns or retires. \u00a0In today&#8217;s letter to Stewart, however, I directed him to the case of former <a href=\"https:\/\/en.wikipedia.org\/wiki\/Mark_Fuller\">U.S. District Judge Mark Fuller<\/a> of Alabama. \u00a0Fuller resigned while he was under investigation, but the Committee on Judicial Conduct recommended his impeachment anyway. \u00a0If Hudspeth covered up a felony to protect another judge, then he should suffer the same indignity as Fuller. Congress should take away Hudspeth&#8217;s retirement and make him live on Social Security.<\/p>\n<p>WHERE ARE THE FEMINISTS AND THE DEMOCRATS?<\/p>\n<p>I&#8217;ve been trying to get Judge Smith impeached for almost two years now, and frankly it&#8217;s been a lonely battle. \u00a0As I wrote about in my recent <a href=\"http:\/\/www.wacotrib.com\/opinion\/columns\/guest_columns\/ty-clevenger-guest-columnist-congressman-flores-refuses-to-go-after\/article_96c0d390-2682-5fda-80b3-474656175dd1.html\">guest column<\/a>, Congressman Bill Flores (a.k.a. &#8220;Spineless Bill&#8221;) talked tough about impeachment during his primary campaign, then <a href=\"http:\/\/lawflog.com\/?attachment_id=1277#main\" rel=\"attachment wp-att-1277\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-1277\" src=\"http:\/\/lawflog.com\/wp-content\/uploads\/2016\/06\/Bill_Flores_Official_Portrait_112th_Congress.jpg\" alt=\"Bill_Flores,_Official_Portrait,_112th_Congress\" width=\"209\" height=\"279\" \/><\/a>dropped the issue as soon as he won re-election. \u00a0I guess that shouldn&#8217;t surprise me. \u00a0Even though the Constitution makes the House of Representatives responsible for impeachment, Congress has long tried to punt that duty back to the judiciary. \u00a0And the judiciary, meanwhile, circles the wagons and protects its own.<\/p>\n<p>I reached out to women&#8217;s organizations, assuming that\u00a0they would jump all over a federal judge who preyed on women, but I assumed wrong. Nobody lifted a finger. I also reached out to Democrats, assuming they would jump all over a corrupt Republican judge.\u00a0Again, nobody lifted a finger. So a federal judge sexually abused\u00a0women in the courthouse, and his colleagues tried to cover\u00a0up most of what he did, but the only person making noise about it is me, a white, pro-life Republican male from rural East Texas. I don&#8217;t get it. I really don&#8217;t.<\/p>\n<p>In a fascinating <a href=\"http:\/\/www.nytimes.com\/2015\/09\/19\/us\/mark-e-fuller-former-judge-could-be-impeached.html\">September 18, 2015 article<\/a> about Judge Fuller&#8217;s case, the <em>New York Times<\/em> noted that Senate Judiciary Chairman Charles Grassley re-introduced legislation to create an independent inspector general for the federal judiciary. \u00a0It&#8217;s a desperately-needed reform, but\u00a0Senator Grassley has not yet moved his own bill out of his own committee. \u00a0So do something about that. Send an email or letter to both of your U.S. senators, and tell them to co-sponsor Senate Bill 1418, the Judicial Transparency and Ethics Enhancement Act of 2015. Seriously, do it.
