I wanted\u00a0to blog about the upcoming elections in Hearne, but Dennis lit a fire under me yesterday, forcing me to hurry up and git &#8216;er done. So grab some Lysol, gather the wife and kids around the iPhone, and get ready for\u00a0another excursion into\u00a0small-town corruption and cronyism.<\/p>\n<p><a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/09\/Dennis-Phillips.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-932 alignright\" src=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/09\/Dennis-Phillips.jpg\" alt=\"\" width=\"270\" height=\"541\" srcset=\"https:\/\/lawflog.com\/wp-content\/uploads\/2015\/09\/Dennis-Phillips.jpg 270w, https:\/\/lawflog.com\/wp-content\/uploads\/2015\/09\/Dennis-Phillips-150x300.jpg 150w\" sizes=\"(max-width: 270px) 100vw, 270px\" \/><\/a>In this week&#8217;s\u00a0edition of the <a href=\"https:\/\/www.robconews.com\/\"><em>News<\/em><\/a>, Dennis endorsed Mayor Ruben &#8220;<a href=\"http:\/\/lawflog.com\/?p=915\">The Godfather<\/a>&#8221; Gomez and Councilman Emmett &#8220;<a href=\"http:\/\/lawflog.com\/?p=1310\">Mankiller<\/a>&#8221; Aguirre for re-election, as well as challenger (and former Councilwoman) LaShunda White, a.k.a. &#8220;<a href=\"http:\/\/lawflog.com\/?p=915\">LaShunda Sellout<\/a>.&#8221; In other words, Dennis endorsed the <a href=\"http:\/\/BoogerCountyMafia.com\">Booger County Mafia<\/a> candidates.<\/p>\n<p>Normally you would expect a journalist (or someone purporting to be one) to oppose corrupt politicians, and normally you would be right, but then Booger County isn&#8217;t\u00a0exactly normal. For that matter, neither is Dennis.<\/p>\n<p>Back in 2015, I reported that <a href=\"http:\/\/lawflog.com\/?p=951\">Dennis and his employer accepted $30,000<\/a> (or 30 pieces of silver, if your prefer) from city officials for the alleged purpose of remodeling\u00a0the headquarters of the newspaper. \u00a0Ever since then, Dennis and the <em>News<\/em> have been dutifully supportive of the corrupt ruling class, <em>i.e.<\/em>, the Booger County Mafia, and harshly critical of the reformers on the city council. Where I grew up, we would call that a payoff. In Booger County, it&#8217;s called business as usual.<\/p>\n<p>According to Dennis, the Mafia candidates are the best choice for economic development and &#8220;progress&#8221; in Hearne. I suppose\u00a0that&#8217;s true if you define &#8220;economic development&#8221; as giving taxpayer money to Dennis and his employer.<\/p>\n<p>Seriously, what self-respecting editorialist\u00a0would endorse Ruben Gomez for mayor? Gomez&#8217;s name is synonymous with corruption, and for good reason. Just Google &#8220;LawFlog&#8221; and &#8220;Gomez&#8221; and read for yourself. \u00a0On September 9, 2015, for example, I reported that the mayor&#8217;s sister, Sylvia Montelongo, had written <a href=\"http:\/\/lawflog.com\/?p=915\">nearly fifty thousand dollars worth of hot checks<\/a> to the city for utilities, but her electricity had never been turned off.<!--more--><\/p>\n<p><a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/04\/Mayor-Gomez-edited.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-716\" src=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/04\/Mayor-Gomez-edited.jpg\" alt=\"\" width=\"319\" height=\"219\" srcset=\"https:\/\/lawflog.com\/wp-content\/uploads\/2015\/04\/Mayor-Gomez-edited.jpg 319w, https:\/\/lawflog.com\/wp-content\/uploads\/2015\/04\/Mayor-Gomez-edited-300x206.jpg 300w\" sizes=\"(max-width: 319px) 100vw, 319px\" \/><\/a>When Gomez&#8217;s current challenger, Milton Johnson, organized a petition drive to force a forensic audit of city finances, Gomez <a href=\"http:\/\/lawflog.com\/?p=1171\">supported a lawsuit<\/a> to block the audit. \u00a0The audit happened anyway and, not surprisingly,\u00a0the auditor found evidence that city officials were manipulating utility bills.<\/p>\n<p>Gomez has since argued that the audit found nothing wrong, but that&#8217;s delusional. Just <a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2017\/04\/Supplemental-production.pdf\">read the audit report<\/a> for yourself. \u00a0And bear in mind that the audit findings would have been a lot more damaging\u00a0but for the fact that the Mafia sabotaged it. \u00a0The city council approved hiring an auditor to report directly to the council, but the city&#8217;s sleazy\u00a0attorneys changed the contract (without council approval) so the auditor would report to them.<\/p>\n<p>Time and again, the audit report alluded\u00a0to serious\u00a0misconduct (including evidence suggesting that Gomez accepted bribes), but it usually stopped\u00a0short by saying that further inquiry was &#8220;beyond the scope&#8221; of the audit. Except it wasn&#8217;t beyond the scope, because the city council never limited the scope.\u00a0Instead, the city&#8217;s law firm (which <a href=\"http:\/\/lawflog.com\/?p=1520\">resigned under a suspicious cloud<\/a>)\u00a0must have limited the scope, because the city council knew nothing about the purported limits.<\/p>\n<p><a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2016\/07\/John-Naron-2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-1339 alignright\" src=\"http:\/\/lawflog.com\/wp-content\/uploads\/2016\/07\/John-Naron-2.jpg\" alt=\"\" width=\"480\" height=\"555\" srcset=\"https:\/\/lawflog.com\/wp-content\/uploads\/2016\/07\/John-Naron-2.jpg 480w, https:\/\/lawflog.com\/wp-content\/uploads\/2016\/07\/John-Naron-2-259x300.jpg 259w\" sizes=\"(max-width: 480px) 100vw, 480px\" \/><\/a>Speaking of that law firm, I suggested several months ago that Interim City Manager John Naron (Gomez&#8217;s errand boy) may have formed an unholy alliance with the firm, allowing it\u00a0to churn grossly excessive legal bills in exchange for representing his interests over the city council&#8217;s (the firm billed more than $100,000 in a six month period even though the city was not involved in litigation).\u00a0The evidence for that unholy alliance is growing.<\/p>\n<p>Before the financial report was finished, I told the city&#8217;s financial\u00a0investigator about the law firm&#8217;s excessive billing, and he told me that the current administration (<em>i.e.<\/em>, Naron&#8217;s administration) was beyond the scope of his investigation. Since those limitations were not imposed by the city council, they must have been imposed by the city&#8217;s attorneys, <a href=\"http:\/\/www.rampagelaw.com\/Attorneys\/George-E-Hyde.shtml\">George Hyde<\/a> and <a href=\"http:\/\/www.rampagelaw.com\/Attorneys\/Sarah-M-Griffin.shtml\">Sarah Griffin<\/a> of <a href=\"http:\/\/rampagelaw.com\">Denton Navarro Rocha Bernal Hyde &amp; Zech, P.C.<\/a> \u00a0In other words, it looks like Hyde and Griffin put themselves and their overbilling beyond the scope of the audit. How convenient.<\/p>\n<p>FOLLOW THE MONEY<\/p>\n<p>Long before the audit began, I voiced my suspicions that city officials were protecting their friends (and punishing their enemies) by <a href=\"http:\/\/lawflog.com\/?p=883\">tampering with utility bills<\/a>. At least two council members\u00a0strongly encouraged the financial investigator to look into\u00a0utility billing, and he did&#8230; sort of.<\/p>\n<p>The financial report discussed\u00a0general problems with utility billing, but it contained surprisingly few details, and most of those details (<em>e.g.<\/em>, about the mayor&#8217;s sister) had already been reported on this blog. There was no information about the number of customers\u00a0affected, nor was there any information about the amount of money at stake. Why not?<\/p>\n<p><a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/04\/Werlinger.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-717\" src=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/04\/Werlinger.jpg\" alt=\"\" width=\"207\" height=\"369\" srcset=\"https:\/\/lawflog.com\/wp-content\/uploads\/2015\/04\/Werlinger.jpg 207w, https:\/\/lawflog.com\/wp-content\/uploads\/2015\/04\/Werlinger-168x300.jpg 168w\" sizes=\"(max-width: 207px) 100vw, 207px\" \/><\/a>You may recall that Naron and the investigator, Ed Martin, tried very hard to convince the city council to <a href=\"http:\/\/www.theeagle.com\/news\/local\/hearne-council-could-see-audit-tuesday-but-decision-on-attorney\/article_fee4a51a-9468-51c4-af21-8169bc599ba1.html\">hire\u00a0an interim attorney<\/a> so the report could be discussed in closed session. Obviously, they wanted to hide something from the public, and Martin even told the media that he was concerned about litigation, but why? \u00a0Here&#8217;s a possibility: if dozens (hundreds?)\u00a0of utility bills were tampered with by city officials, the city could be facing some nasty lawsuits, and the perpetrators could go to federal prison for wire fraud and mail fraud. I have to wonder if Hyde and Griffin directed Martin to omit the details for that very reason.<\/p>\n<p>And voters should remember that LaShunda White and Emmett Aguirre <a href=\"http:\/\/lawflog.com\/?p=1171\">voted to filed suit<\/a> in order to keep their constituents from voting on whether the city should be audited. They also voted to reappoint Michael &#8220;Sticky Fingers&#8221; Werlinger to the city council shortly after voters threw him off (Werlinger, you may recall, received college football tickets that were <a href=\"http:\/\/lawflog.com\/?p=883\">purchased with the city manager&#8217;s credit card<\/a>). At the next opportunity, voters booted\u00a0Werlinger <em>and<\/em> White from the council.<\/p>\n<p>Yet here comes Lashunda White again, trying to get her nose back in the public trough. Just remember, she has <a href=\"http:\/\/lawflog.com\/?p=915\">sold out her supporters before<\/a>, and she will do it again. Incidentally, someone should ask White\u00a0how many times someone at City Hall\u00a0intervened to keep her electricity from being shut off for non-payment. In fact, I challenge her to make those records public. Otherwise, people might assume that she tried to block the audit because she had something to hide. And if she couldn&#8217;t afford to pay her utility bills, where did she get the money for that new Lincoln SUV? \u00a0Yeah, I&#8217;m talking about the SUV\u00a0that she started driving right after\u00a0she sold out her supporters and joined the Mafia.<\/p>\n<p>GET OUT AND VOTE<\/p>\n<p>The choice in the upcoming election could not be clearer. If you want more corruption and cronyism at City Hall, then vote for the Mafia candidates: Ruben Gomez, Emmett Aguirre, and LaShunda White. \u00a0If you&#8217;re tired of being ripped off, then vote for Milton Johnson, Shirley Harris, and Ola Mae Redmond.<\/p>\n<p>Full disclosure: I represent Johnson and Harris in several legal matters.
