{"id":2078,"date":"2018-12-21T01:01:23","date_gmt":"2018-12-21T05:01:23","guid":{"rendered":"http:\/\/lawflog.com\/?p=2078"},"modified":"2018-12-23T21:12:58","modified_gmt":"2018-12-24T01:12:58","slug":"fbi-investigating-texas-alcoholic-beverage-commission-chief-liquor-cop-was-promoted-while-under-internal-investigation","status":"publish","type":"post","link":"https:\/\/lawflog.com\/?p=2078","title":{"rendered":"FBI investigating Texas Alcoholic Beverage Commission, chief liquor cop was promoted while under internal investigation"},"content":{"rendered":"\n<p>The Texas Alcoholic Beverage\nCommission&#8217;s chief cop, Victor Kuykendoll, was promoted to the\nposition while he was still under investigation for assaulting\nanother agent, and even after the agency concluded that Kuykendoll\nhad interfered with an ongoing criminal investigation of two of his\nfriends. Meanwhile, the FBI and Travis County District Attorney&#8217;s\nOffice are investigating Kuykendoll and other TABC officials (more on\nthat below).<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/lawflog.com\/wp-content\/uploads\/2018\/12\/victor_kuykendoll.jpg\" alt=\"\" class=\"wp-image-2081\" width=\"164\" height=\"219\"\/><figcaption>Victor Kyukendoll<br>Chief of Enforcement<br>TABC<\/figcaption><\/figure><\/div>\n\n\n\n<p>According to a <a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2018\/12\/R000058-091118-production.pdf\">heavily-redacted report<\/a> released in response to an open records request, an unnamed agent alleged that he was groped by Kuykendoll and Sgt. Jeffery Farmer while attending a colleague&#8217;s retirement party in Waco. I received the report from Darryl Darnell, a retired lieutenant and regular thorn-in-the-side of the TABC brass (may God bless him), who noted that the \u201cinvestigation\u201d appeared to be an attempt to exonerate Kuykendoll.<\/p>\n\n\n\n<p>The assault allegation was \u201cnot\nsustained\u201d by the internal TABC investigator, Lt. Peter Heller, but\nthe report contains findings far more damning than an assault.\nConsider this excerpt:<\/p>\n\n\n\n<p><\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p><em>According to [TABC Special Investigations Unit] Investigative Reports, on September 13, 2017, Agent Marvin Padgett \u201csaved screen shots showing friends\u201d on the Facebook Page of AC [i.e., \u201cActing Chief\u201d] Kuykendoll, and one of his \u201cFacebook Friends\u201d, Rami Altrach, was a person on a Terrorist Watch list. Based on this information, SIU opened the investigation into the alleged illegal activity of AC Kuykendoll, [Tom] Noble, and [Wayne] Stovall.  <br><br> SIU discovered AC Kuykendoll began deleting Facebook pictures related to Rami Alatrach on or before October 27th. In stark contrast to \u201ca couple months after\u201d the October 26th party, that  AC Kuykendoll asserted.<\/em><\/p><\/blockquote>\n\n\n\n<p>Kuykendoll, Noble and Stovall were longtime friends who had worked together in the Waco field office, according to a former TABC agent whom I&#8217;ll call \u201cAgent X.\u201d Rami Altrach was a Lebanese national who owned a night club and a car lot in Bell County, according to Agent X, and Agent X was fired by TABC in May after he reported the alleged criminal activity (more on that below). <\/p>\n\n\n\n<p class=\"has-text-color has-vivid-red-color\">[UPDATE (12\/21\/2018 10:50 a.m. ET): I received an email (<a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2018\/12\/2018.12.21-Wayne-Stovall-email.pdf\">click here<\/a>) and record excerpt (<a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2018\/12\/Allegation-10.pdf\">click here<\/a>) from Wayne Stovall indicating that TABC found the charges &#8220;unsustained&#8221; with respect to any connection between him and Altrach. The email is worth reading, and I&#8217;ve requested a full copy of the record.<\/p>\n\n\n\n<p>[Continued on Page 2&#8230;]<\/p>\n\n\n\n<!--nextpage-->\n\n\n\n<p>Here&#8217;s the real kicker: At the time that TABC Executive Director Bentley Nettles promoted Kuykendoll to chief, the agency had already \u201csustained\u201d a finding that Kuykendoll interfered in SIU&#8217;s criminal investigation of his buddies, Noble and Stovall. The <a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2018\/12\/R000058-091118-production.pdf\">latest report<\/a> notes that \u201cAC Kyukendoll was &#8216;Sustained&#8217; on allegation #8 of (OPR 2018-10) for authorizing the transfer of two agents; which influenced, compromised, and obstructed an OPR and SIU investigation.\u201d<\/p>\n\n\n\n<p>Did Director Nettles and the TABC\ncommissioners know that they were appointing such a tainted cop to\nlead Texas&#8217;s third-largest state law enforcement agency? I asked\nDirector Nettles in an email, and I got a response from TABC\nspokesman Chris Porter. \u201cChief Kuykendoll has been a valued member\nof TABC for many years,\u201d Porter wrote. \u201cHe has proven himself\ntime and again as a man of integrity and leadership, and he has the\nfull confidence of the agency\u2019s Executive Director and the\nCommissioners.\u201d<\/p>\n\n\n\n<p>Oy vey. Does anybody remember the beatdown that Sherry Cook, the former TABC director, got from state legislators two years ago? She was forced into retirement and most of the TABC leadership was driven out because of systemic corruption and cronyism, yet it looks like the organization&#8217;s culture is as corrupt as ever.<\/p>\n\n\n\n<p>Elsewhere in his statement, Porter\nwrote that TABC was unable to comment on whether \u201coutside agencies\u201d\nwere investigating. I&#8217;ve reprinted the entire statement at the bottom\nof the post.<\/p>\n\n\n\n<p>Now, back to Agent X. I can&#8217;t just take\ntips from strangers at face value, so I did a little investigating.\nAgent X previously worked at another law enforcement agency, and I\nhappen to have known the chief (whom I&#8217;ll call \u201cChief X\u201d) for\nmore than 30 years.  The chief described Agent X as a \u201cstraight\nshooter\u201d with no tolerance for dirty cops.<\/p>\n\n\n\n<p>Chief X was also able to corroborate\nmuch of what Agent X told me. Agent X said local agencies in Bell\nCounty had been trying for years to get TABC to act against Rami\nAltrach, but the TABC agents always seemed to be running\ninterference. According to Agent X, investigators discovered that\nnumerous cars from Altrach&#8217;s car lot had titles assigned to one of\nKuykendoll&#8217;s TABC buddies.<\/p>\n\n\n\n<p>According to Agent X, he has been\ncooperating with both the FBI and the Travis County District\nAttorney&#8217;s Office, and Kuykendoll was called before the Travis County\nGrand Jury last week. He said Altrach returned to his native Lebanon\nshortly after he was interviewed by the FBI.<\/p>\n\n\n\n<p>Agent X also told me about a TABC agent who was recently promoted to major despite a \u201csustained\u201d finding that he had been deleting records about a nightclub in Dallas. Agent X said the bar had been an ongoing problem for Dallas PD, and that drugs and other evidence from the bar had disappeared from TABC along with the report.  I guess the [organic fertilizer] still floats to the top at TABC.<\/p>\n\n\n\n<p>As a native Texan and former cop, I&#8217;m disgusted by what I&#8217;ve seen in Austin. Too many state officials want to rant and rave about &#8220;The Swamp&#8221; in DC while ignoring the swamp in Austin. I&#8217;ve been active in Republican politics since I was a teenager, but I have to say I&#8217;m generally unimpressed with the quality of our overwhelmingly Republican state government.<\/p>\n\n\n\n<p>I could write more, but it&#8217;s late, I&#8217;m tired, and I don&#8217;t get paid to blog. These findings are fully outlined in the report, which was released under the Public Information Act.<br>&nbsp;<br>TABC holds each of its employees to the highest standards of conduct and professionalism. This agency\u2019s leaders are expected to exemplify the agency\u2019s core values of service, integrity, accountability and customer service. As such, we take any allegations of misconduct extremely seriously and thoroughly investigate all complaints against agency employees and leaders. In this case, the allegations against Chief Kuykendoll were not sustained and do not warrant further action.<br>&nbsp;<br>TABC is unable to comment on any investigations by outside agencies or groups.
