As usual, the Texas Department of Public Safety is trying to keep things quiet.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignright is-resized\"><img decoding=\"async\" src=\"http:\/\/lawflog.com\/wp-content\/uploads\/2019\/02\/Brent-Davis.jpg\" alt=\"\" class=\"wp-image-2141\" width=\"-60\" height=\"-43\" srcset=\"https:\/\/lawflog.com\/wp-content\/uploads\/2019\/02\/Brent-Davis.jpg 496w, https:\/\/lawflog.com\/wp-content\/uploads\/2019\/02\/Brent-Davis-300x215.jpg 300w\" sizes=\"(max-width: 496px) 100vw, 496px\" \/><\/figure><\/div>\n\n\n\n<p>The former ranger gained notoriety in 2018 after DPS learned that he had been <a href=\"https:\/\/lawflog.com\/?p=2109\">sleeping with the widow<\/a> of Ron Horaney of Longview, whose murder he was supposed to be investigating. The revelation caused considerable embarrassment to DPS and likely compromised the murder investigation.<\/p>\n\n\n\n<p>According to my sources, several rangers appeared last week at DPS offices in Tyler, where Trooper Davis had been patrolling a desk since 2018, and they removed all law-enforcement property assigned to Davis, including his uniform and state vehicle. One source informed me this afternoon that Davis submitted his retirement papers this week. <\/p>\n\n\n\n<p>Former and current DPS personnel initially suspected that Davis was stripped of his weapons because he would soon be arrested. As I <a href=\"https:\/\/lawflog.com\/?p=2136&amp;page=2\">reported in early 2019<\/a>, several of my law enforcement friends thought Davis and the widow, Faezah Horaney, should have been at the top of the list of murder suspects. [Continued on p.2].<\/p>\n\n\n\n<!--nextpage-->\n\n\n\n<p>A different theory emerged this afternoon: a source told me DPS discovered that Davis rekindled his affair with Mrs. Horaney and as of last week was living with her. I have not been able to confirm that information, and DPS has been rather unforthcoming.<\/p>\n\n\n\n<p>I asked the DPS media office on Monday for comments about whether and why Davis had been stripped of his badge and gun. More than 48 hours later, the PR office hasn\u2019t said a word, even though it normally responds within a few hours.<\/p>\n\n\n\n<p>I also discovered on Monday that DPS apparently withheld records about Davis that I subpoenaed back in July. I represent former Special Agent Darren Lubbe against DPS brass in <em>Lubbe v. Milanovich<\/em>, Case No. 1:18-cv-1011 (W.D. Tex.), and we requested the following:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>All reports, records, documents, and correspondence pertaining to or arising from the matters described in Paragraph 77 of the SAC. This request includes, but is not limited to, reports, records, documents and correspondence exchanged with other agencies regarding Brent Davis\u2019s role in the Horaney murder investigation. If, for example, DPS has exchanged information with the Gregg County Sheriff\u2019s Office or Federal Bureau of Investigation regarding Mr. Davis, that information should be produced.<\/p><\/blockquote>\n\n\n\n<p>You can read the subpoena by <a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2020\/12\/2020.07.06-Subpoena-to-DPS-merged.pdf\">clicking here<\/a> and you can read the SAC (<em>i.e.<\/em>, \u201cSecond Amended Complaint\u201d) by <a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2020\/12\/2019.10.30-Second-Amended-Complaint-stamped.pdf\">clicking here<\/a>. DPS did not make any objections to the subpoena, thus any objections are waived. Instead, DPS produced thousands of pages of other documents, and it apparently hoped I would overlook the missing ones.
