{"id":529,"date":"2015-02-02T03:20:15","date_gmt":"2015-02-02T03:20:15","guid":{"rendered":"http:\/\/lawflog.com\/?p=529"},"modified":"2015-03-09T15:50:45","modified_gmt":"2015-03-09T15:50:45","slug":"appellate-court-orders-hearne-to-hold-recall-election","status":"publish","type":"post","link":"https:\/\/lawflog.com\/?p=529","title":{"rendered":"Appellate court orders Hearne to hold recall election"},"content":{"rendered":"<p>This evening the Tenth Court of Appeals in Waco ordered the Hearne City Council to hold a recall election for City Councilwoman Maxine Vaughn within 35 days. \u00a0You can read the opinion by <a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/02\/2015.02.02-Appellate-opinion.pdf\">clicking here<\/a>.<\/p>\n<p>Congratulations to my clients, Councilwomen Hazel Embra, Joyce Rattler, and Lashunda White, as well as former mayor Milton Johnson,\u00a0<img loading=\"lazy\" decoding=\"async\" class=\"alignright  wp-image-313\" src=\"http:\/\/lawflog.com\/wp-content\/uploads\/2014\/08\/Rusty.249111858_std-300x300.jpg\" alt=\"Rusty.249111858_std\" width=\"272\" height=\"272\" srcset=\"https:\/\/lawflog.com\/wp-content\/uploads\/2014\/08\/Rusty.249111858_std-300x300.jpg 300w, https:\/\/lawflog.com\/wp-content\/uploads\/2014\/08\/Rusty.249111858_std-150x150.jpg 150w, https:\/\/lawflog.com\/wp-content\/uploads\/2014\/08\/Rusty.249111858_std.jpg 374w\" sizes=\"(max-width: 272px) 100vw, 272px\" \/>all of whom have battled Hearne City Attorney Bryan F. &#8220;Rusty&#8221; Russ, Jr.&#8217;s underhanded schemes to block the election. I have attached a copy of my <a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/02\/2014.12.16-Letter-to-Coty-Siegert.pdf\">December 16, 2014 letter to Robertson County District Attorney Coty Siegert<\/a>\u00a0that explains how Mr. Russ committed a third-degree felony while trying\u00a0to maintain\u00a0his grasp on power.<\/p>\n<p>If Ms. Vaughn is recalled, my clients will have a 3-2 majority on the city council, and they have repeatedly said the first order of business will be to fire Mr. Russ, who makes more than $4,700 per month for a part-time job even though (1) he does not prosecute traffic offenses, and (2) he charges extra for any litigation that he works on. Based on my review, that&#8217;s more than three times what an average city attorney makes in a town the size of Hearne.<\/p>\n<p>On Friday, February, 6, 2015 at 10 a.m., Visiting Judge Reva Towslee-Corbett will hear my <a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/02\/2014.12.22-District-court-motion-for-sanctions-merged.pdf\">motion to sanction Mr. Russ<\/a>, refer him to the State Bar of Texas, and enjoin him from filing any additional legal claims without first getting approval from\u00a0the city council. The hearing in the Robertson County Courthouse will be open to the public, so come one and all.<!--more--><\/p>\n<p>In a <a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/01\/2014.12.25-Letter-to-editor.pdf\">letter to the editor<\/a>\u00a0that was published in the December 25, 2014 edition of the <em>Robertson County News<\/em>, Mr. Russ claimed that he <em>did<\/em> consult with the city council before filing claims in district court on behalf of the city, and he flatly accused my clients of lying about him. According to Mr. Russ, he advised the city council about his plans during an executive session.<\/p>\n<p>On January 2, 2015, I filed a <a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/02\/2015.01.02-District-court-supplemental-brief.pdf\">supplemental brief in the district court<\/a>\u00a0challenging Mr. Russ to &#8220;put his money where his mouth is&#8221; by repeating the statements in his letter to the editor under oath and filing a copy with the\u00a0court. \u00a0I also challenged Mr. Russ to produce a sealed copy of the audio recording of the alleged executive session so that Judge Towslee-Corbett could examine it.<\/p>\n<p>Councilwomen Embra, Rattler, and White all <a href=\"http:\/\/lawflog.com\/wp-content\/uploads\/2015\/02\/2015.01.02-District-court-exhibits.pdf\">produced sworn affidavits<\/a>\u00a0testifying that Mr. Russ did <strong><em>not<\/em><\/strong> notify the city council about what he was doing in court, much less get the city council&#8217;s approval. \u00a0To date, Mr. Russ has not produced an affidavit affirming his letter to the editor, nor has he produced the audio tape of the alleged executive session.
